Regulatory Update: Forwarders Handling Air Cargo Face Increased Civil Penalties
Two federal agencies recently increased the maximum civil penalties applicable to violations of federal regulations impacting forwarders that handle air cargo.
The Transportation Security Administration (TSA) announced that the maximum civil penalty for violations of TSA requirements by Indirect Air Carriers, Certified Cargo Screening Facilities, and other TSA-regulated entities has increased from $16,630 to $17,062. The Pipeline and Hazardous Materials Safety Administration (PHMSA) announced that the maximum civil penalty for violations of the Hazardous Materials Regulations (or international hazardous materials standards, if applicable) has increased from $99,756 to $102,348. In addition, for violations resulting in death or serious injury, the maximum civil penalty has increased from $232,762 to $238,809.
