His experience includes significant appellate litigation before the Labor & Industry Review Commission, Circuit Court, and Court of Appeals. McFarlane counsels on high-value workers’ compensation cases involving complex facts and legal issues. His work includes:
- Investigations
- Preparing case analyses for clients – outlining current and potential workers’ compensation exposures and defenses
- Assisting the team in managing the direction of the litigation
- Drafting global settlement agreements to help clients proactively avoid potential claims not covered in the Workers’ Compensation Act
- Guiding clients through subrogation opportunities to recover benefits paid
He regularly works with administrative law judges at the Wisconsin Worker’s Compensation Division. As part of this, he works informally and at hearings and mediations to facilitate efficient and cost-effective disposition of cases, predominantly through negotiated compromise agreements.
