Clifford Lauchlan’s practice is concentrated on cargo claims and commercial litigation, with a particular focus on representing third-party logistics providers, brokers, shippers, and other transportation industry clients. He regularly defends and pursues cargo damage claims, including subrogation, fraud, and theft matters, and advises clients on strategies to minimize exposure and recover losses arising from freight claims.

In addition to his cargo practice, Clifford represents clients in a broad range of commercial litigation matters in state and federal courts. His experience includes disputes involving transportation contracts, vicarious liability, negligent hiring of carriers, insurance coverage and risk allocation, enforcement and defense of employment and restrictive covenant agreements, collections, and other complex business disputes.

He also advises clients on contract drafting and risk management issues, with an emphasis on strengthening contractual protections and reducing litigation risk in the transportation context.

His experience includes:

  1. Handled millions of dollars’ worth of cargo claims from the broker, carrier, and shipper perspectives, successfully prosecuting and defending high-exposure matters across a broad range of loss scenarios.
  2. Enforced and defended noncompetition and non-solicitation agreements, obtaining favorable outcomes in restrictive covenant disputes.
  3. Advised clients on complex, multi-party transportation contracts, including drafting, negotiation, risk allocation, indemnity, and liability allocation analysis.
  4. Navigated disputes arising from international and intermodal transportation arrangements, including matters involving carriers, brokers, shippers, and third-party logistics providers.
  5. Reviewed and analyzed insurance coverage issues, including cargo, commercial general liability, and related transportation policies, and advised clients regarding coverage positions, tender strategy, and risk mitigation.
